1. Overview

Welcome to VICINO.

This website is operated by Jake Polhill, trading as VICINO, an independent running apparel brand based in the United Kingdom.

Throughout these Terms of Service, “we”, “us” and “our” refer to Jake Polhill trading as VICINO.

By accessing our website or purchasing products from us, you agree to these Terms of Service.

Nothing in these terms affects your statutory rights as a consumer.

2. Our Products

VICINO sells running apparel and related products.

We aim to ensure that product descriptions, photographs, sizing information and prices are accurate.

However, colours may appear slightly different depending on your screen settings.

We reserve the right to update our product range, descriptions and prices at any time. Price changes will not affect orders already accepted.

3. Orders and Payments

All prices are displayed in British pounds (GBP).

When you place an order, you are making an offer to purchase the selected products. An order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.

A contract is formed when we send you confirmation that your order has been dispatched.

We may cancel an order before dispatch if a product is unavailable, payment cannot be authorised or an obvious pricing error has occurred. If payment has already been taken, we will issue a refund.

Payments are processed securely through the payment providers available at checkout.

4. Delivery

We currently offer free standard tracked delivery within the United Kingdom.

We aim to dispatch orders within one working day of receiving an order. Orders placed on weekends or UK bank holidays will normally be dispatched on the next working day.

Once dispatched, orders are estimated to arrive within 3–5 working days.

Delivery times are estimates rather than guaranteed delivery dates.

Unless we have agreed otherwise, goods will be delivered without undue delay and within 30 days of the contract being formed.

The risk of loss or damage to goods generally passes to you when you, or someone you nominate other than the carrier, takes physical possession of them.

5. Returns and Refunds

If you purchase from us online, you generally have the right to cancel your order within 14 days of receiving your goods, without giving a reason.

After notifying us of cancellation, you have a further 14 days to return the goods.

Customers are responsible for return postage when cancelling because they have changed their mind, provided this was disclosed before purchase.

Where a valid cancellation applies, we will refund the product price and any standard outbound delivery charges paid, in accordance with applicable consumer law.

We may make a deduction for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Refunds will be processed in accordance with applicable consumer law and our Returns & Refunds Policy.

If an item is faulty, damaged or not as described, your statutory rights under the Consumer Rights Act 2015 apply.

6. Product Availability

All products are subject to availability.

As we produce and release items in small quantities, some sizes or products may sell out.

If we are unable to fulfil an order, we will contact you and provide an appropriate refund.

7. Website Use

You agree not to use our website for unlawful or fraudulent purposes or in a way that interferes with its operation or security.

We may restrict access where reasonably necessary to protect the website, our customers or our business.

8. Intellectual Property

The VICINO name, branding, original designs, photographs, written content and other materials on this website are owned by us or used with permission, as applicable.

You may not reproduce, distribute or commercially use our protected materials without appropriate permission.

9. Third-Party Services

Our website is powered by Shopify and may use third-party services for payment processing, delivery and other store functions.

These services may have their own terms and privacy policies.

Our use of third-party providers does not remove any responsibilities we have to you under applicable law.

10. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms limits your statutory consumer rights.

We are not responsible for losses that are not reasonably foreseeable, except where the law requires otherwise.
